HB 1187 - Pay-for-Success Contracts

• Creates section 287.05715 of Florida Statutes to authorize state agencies to negotiate and enter into pay-for-success contracts with private, nonprofit entities to fund evidence-based social service and health care programs, contingent on General Appropriations Act authorization.

• Requires private entities to secure upfront capital from private funders (foundations, banks, businesses, individuals) and subcontract with service providers, with state payment only upon achievement of specified performance outcomes verified by an independent evaluator.

• Mandates state agencies determine performance outcome measures, select independent evaluators through competitive solicitation, ensure participant data sharing agreements, and prohibit private entities from accessing personally identifiable participant information.

• Requires private entities to file annual reports with state agencies for the contract duration and exempts pay-for-success contracts from standard procurement requirements under section 287.057.

• Appropriates $850,000 nonrecurring from General Revenue Fund to the Department of Health for 2017-2018 fiscal year to implement the Nurse-Family Partnership pay-for-success program in designated healthy start coalitions and federally qualified health centers; requires Department of Management Services to prescribe procedures by December 1, 2017; effective July 1, 2017.
