Department of Agriculture and Consumer Services must compile and provide annual reports to the Department of Environmental Protection on nutrient applications within basins that have basin management action plans to meet total maximum daily loads.

Department of Agriculture and Consumer Services may request nutrient management and application records from landowners, dischargers, and other responsible parties within such basins.

Agricultural records relating to production processes, costs, profits, or financial information held by the Department of Agriculture and Consumer Services remain confidential and exempt from public disclosure, except when released to the Department of Environmental Protection or water management districts with confidentiality protections maintained.

Best management practices and interim measures for agricultural pollution sources must be adopted by rule and may be implemented by responsible parties, with effectiveness verified at representative sites by the Department of Environmental Protection.
