CS/HB 1289 - Local Financial Emergencies

• Expands oversight entities for local governments, charter schools, charter career centers, and district school boards to include the Senate, House of Representatives, and Legislative Auditing Committee.

• Establishes financial emergency boards consisting of 7-13 members, with Governor appointing members for local entities and State Board of Education appointing members for school boards, with chair requirements including experience in inspection general, law enforcement, auditing, or fraud examination.

• Grants financial emergency boards broad investigative powers including authority to issue subpoenas, hire legal counsel, access all records and data, and require sworn statements from individuals.

• Requires board recommendations to be submitted within 60 days to the Governor, legislative leaders, and the entity under review, with board members of non-compliant entities subject to suspension for malfeasance and misfeasance.

• Takes effect upon becoming law without a specified date.
