HB 1371 Summary

• Authorizes individuals to donate electronic health records (EHRs) and qualified EHRs to accredited medical or dental schools, universities, hospitals, or repositories for medical research and education purposes through multiple methods: donor cards, driver's licenses, living wills, wills, or signed documents.

• Requires EHRs donated by health care surrogates to be de-identified and establishes procedures for donors to amend or revoke donations through signed statements, oral statements to witnesses, or document destruction.

• Mandates the Agency for Health Care Administration and Department of Highway Safety and Motor Vehicles to develop a program encouraging EHR donations during driver's license and identification card issuance and renewal, with notations on cards to identify donors.

• Expands the definition of "health care decision" to include surrogates' authority to donate a deceased principal's EHRs, and expands the suggested health care surrogate designation form to explicitly authorize the donation of electronic health records.

• Takes effect July 1, 2017.
