HB 1407 Summary: Florida Trust Act

• Prohibits state and local law enforcement agencies, school officers, and security agencies from using resources to investigate, arrest, or detain individuals for federal immigration enforcement purposes, including responding to ICE detainers and holds.

• Restricts state and local agencies and healthcare providers from inquiring about or recording immigration status information, except when directly relevant to eligibility for specific benefits/services, ongoing law enforcement investigations, or required by state/federal law.

• Requires state and local law enforcement agencies to review and revise confidentiality policies to ensure collected information is limited and not disclosed beyond its authorized purpose.

• Mandates the Attorney General develop model policies for K-12 schools, postsecondary institutions, hospitals, and courthouses to ensure accessibility regardless of immigration status and limit immigration enforcement assistance on their premises.

• Authorizes the Attorney General or state attorneys to bring injunctive proceedings against state entities, officials, law enforcement agencies, or local government entities found in violation; takes effect July 1, 2017.
