HB 6043 Summary

• Repeals sections 366.93 and 366.95 of Florida Statutes, which established cost recovery mechanisms and financing provisions for nuclear and integrated gasification combined cycle power plants.

• Deletes provisions from section 403.519 that protected utilities from challenges to their right to recover pre-commercial operation costs for nuclear power plants.

• Allows the Florida Public Service Commission to determine need for nuclear or integrated gasification combined cycle power plants within 90 days of petition filing and issue a decision within 135 days.

• Establishes that utilities can only recover pre-commercial operation costs if the Commission finds costs were imprudently incurred, and protects utilities from cost increase liability for events beyond their control.

• Takes effect July 1, 2017.
