Orange County is authorized to appropriate and pay $2,813,536.09 to Robert Allan Smith as compensation for injuries sustained in a September 7, 2006 motor vehicle accident caused by negligence of an Orange County employee.

The accident occurred when an Orange County work van driven by employee Lynn Lawrence Godden failed to yield at a stop sign and struck Smith's motorcycle, causing traumatic amputation of his right leg above the knee, fractured left leg, broken pelvis and sacrum, and internal organ damage.

Orange County has already paid $100,000 of the $2,913,536.09 judgment entered November 27, 2012, and this act authorizes payment of the remaining balance.

The Agency for Health Care Administration must be paid all unreimbursed Medicaid medical payments before funds are disbursed to Smith.

Attorney fees are capped at $562,707.218, lobbying fees at $140,676.80, and costs and other expenses at $70,351.88.
