HB 6541 Summary

• Appropriates $1.75 million from the General Revenue Fund to the Department of Highway Safety and Motor Vehicles for relief of the Estate of Danielle Maudsley for her death resulting from alleged negligence by Trooper Daniel Cole of the Florida Highway Patrol.

• Compensates the remaining balance of a May 2015 settlement agreement after the Division of Risk Management of the Department of Financial Services already paid $200,000 under statutory liability limits.

• Chief Financial Officer shall issue a warrant for $1.75 million to the Estate of Danielle Maudsley, minus payments needed to satisfy outstanding Medicaid liens for her medical expenses.

• The combined payments from the Risk Management Division ($200,000) and this appropriation ($1.75 million) constitute sole compensation for all present and future claims arising from Ms. Maudsley's death.

• Limits attorney fees, lobbying fees, costs, and similar expenses to no more than 25 percent of the amount awarded under this act, with an effective date of July 1, 2017.
