City of Miami authorized to appropriate $2,300,000 to Marilyn Jelks as legal guardian of Mary Mifflin-Gee to be placed in a Special Needs Trust for her exclusive benefit.

Settlement compensates Mary Mifflin-Gee for injuries sustained on October 25, 2012, when Miami Fire-Rescue personnel negligently failed to secure her to a gurney, causing her to fall and suffer severe traumatic brain injury.

Claimant suffered permanent injuries including persistent vegetative state, tracheostomy dependency, 93 percent physical impairment, with past medical expenses of $1,168,857.93 and future care costs estimated in the millions.

Settlement comprised of $2 million from Lloyd's of London insurance and $200,000 from the City of Miami under sovereign immunity limits in Florida Statutes section 768.28.

Attorney fees related to the claim limited to a maximum of 25 percent of the $2,300,000 award, and this payment constitutes sole compensation for all present and future claims arising from the incident.
