Orange County is directed to appropriate and pay $2,813,536.09 to Robert Allan Smith as compensation for injuries sustained from a negligence claim arising from a September 7, 2006 motorcycle collision with an Orange County employee's vehicle.

Orange County employee Lynn Lawrence Godden negligently drove through a stop sign on Orlando Street and struck Smith's motorcycle, causing a traumatic amputation of his right leg above the knee, fractured pelvis, broken left leg, and internal organ damage.

The payment represents the remaining balance of a $2,913,536.09 final judgment entered November 27, 2012, after Orange County's $100,000 statutory liability payment under Florida law and reductions for comparative negligence and Medicaid setoffs.

Orange County must pay the Agency for Health Care Administration all unreimbursed Medicaid medical payments before disbursing funds to Smith.

Attorney fees relating to this claim are limited to a maximum of 25 percent of the amount awarded under the act.
