Adds gender and gender identity as protected characteristics for felony and misdemeanor reclassification when a crime evidences prejudice against the victim, with the same penalty enhancement reclassification structure as existing protected categories.

Defines "gender identity" as a victim's internal sense of being male, female, or a combination of both, which may differ from the gender determined at birth.

Broadens the definition of "disability" in hate crime reclassification statutes from "mental or physical disability" to any "physical or mental impairment that substantially limits a person's ability to perform one or more major life activities."

Clarifies that crimes evidencing prejudice "in whole or in part" based on protected characteristics qualify for reclassification, applying to both section 775.085 and 775.0863.

Takes effect July 1, 2017.
