CS for SB 1670 - Juvenile Justice Summary

• Requires the Department of Health to waive birth certificate fees for juvenile offenders in the custody or supervision of the Department of Juvenile Justice.

• Establishes "prolific juvenile offender" classification for children charged with a felony who have prior felony adjudications and five or more arrest events, adjudications, or withheld adjudications (at least three felony-level).

• Requires children meeting prolific juvenile offender criteria or charged with firearm possession on school property to be placed in secure detention until their detention hearing, and mandates adjudicatory hearings within 45 days unless the child requests delay.

• Limits secure detention for prolific juvenile offenders to 21 days before adjudication (or 30 days with extension) and 15 days after adjudication, with option for nonsecure detention with electronic monitoring until case disposition.

• Requires courts to place all adjudicated children awaiting placement in nonsecure, high-risk, or maximum-risk residential commitment programs in secure detention until placement is accomplished; appropriates $5,956,024 for fiscal year 2017-2018.
