CS/HB 105 Summary

• Officers who qualify for federal public office must resign from their current office if term lengths run concurrently, with resignation submitted at least 10 days before qualifying for the new office.

• Resignations must be irrevocable and effective no later than either the date the officer would take office if elected or the date their successor is required to take office.

• Failure to submit a required resignation constitutes an automatic irrevocable resignation effective immediately from the current office.

• A resignation creates a vacancy in elective office to be filled by election, allowing candidates to qualify as if the officer's term were expiring normally.

• Exception applies to elected officers whose current term is scheduled to expire and be filled in the same primary and general election period as the federal office they are seeking.
