HB 125 (2018) - Devin's Law

• Law enforcement agencies must prepare reports identifying all Schedule I, II, III, or IV controlled substances found on or near a deceased person or in their possessions when death results from apparent drug overdose.

• Law enforcement must identify the prescriber or deliverer of the controlled substance if known or ascertainable, and classify the death as a "suspicious death" or "death investigation" absent mitigating circumstances.

• Mitigating circumstances allow deviation from mandatory classification if the decedent lawfully obtained the controlled substance(s) that contributed to the death.

• Medical examiners preparing reports under Florida Statutes s. 406.11 must include information identifying all Schedule I, II, III, or IV controlled substances found with the deceased and the law enforcement agency's death classification.

• Effective date: July 1, 2018.
