Requires contracted electronic health records vendors to release records to another vendor selected by a health care provider within 30 days after contract termination.

Mandates contracts between vendors and health care providers include provisions for liquidated damages of at least 20 percent of annual vendor payment for noncompliance with record transfer requirements.

Makes vendors liable for payment of liquidated damages specified in service contracts if they fail to transfer designated electronic health records within the required timeframe.

Establishes liability for persons who forge signatures on authorization forms, materially alter authorization forms without permission, or obtain authorization forms or health records under false pretenses, including compensatory damages and reasonable attorney's fees and costs.

Takes effect July 1, 2018.
