Governor must appoint a new member to the Environmental Regulation Commission within 90 days after a vacancy occurs, subject to Senate confirmation.

Commission consists of 7 state residents appointed by the Governor for 4-year terms, representing agriculture, development industry, local government, environmental community, lay citizens, and scientific/technical experts.

Proposed rules containing standards require a simple majority vote for approval or modification by the commission.

Air quality and water quality standards require a minimum of 4 affirmative votes for commission approval or modification.

Proposed rules failing to receive required votes are deemed disapproved; effective date is July 1, 2018.
