Information that is confidential or exempt under Florida law retains its protected status when obtained by an elder abuse fatality review team conducting a review.

Any information in records created by an elder abuse fatality review team that reveals the identity of an elder abuse victim is confidential and exempt from public records requirements under section 119.07(1) and Article I, Section 24(a) of the State Constitution.

Portions of elder abuse fatality review team meetings where confidential or exempt information or victim identity is discussed are exempt from public meeting requirements under section 286.011 and Article I, Section 24(b) of the State Constitution.

The exemptions in subsections (10) and (11) are subject to the Open Government Sunset Review Act and shall be repealed on October 2, 2023, unless the Legislature reenacts them.

The act takes effect on the same date that HB 259 or similar legislation takes effect, if adopted in the same legislative session and becomes law.
