CS/HB 291 Summary

• Creates the Prescription Drug Donation Repository Program within the Department of Health to facilitate donation of prescription drugs and supplies to indigent, uninsured, and underinsured Florida residents through centralized and local repositories.

• Establishes eligible donors (nursing homes, hospices, hospitals, pharmacies, drug manufacturers, wholesalers, medical device suppliers, and prescribers) and eligible drugs (FDA-approved drugs in original sealed packaging with more than 3 months expiration date, stored at proper temperatures, with no signs of tampering).

• Requires licensed pharmacist inspection of all donations, centralized repository maintenance of drug inventory, local repository notification within 5 days of receiving donations, and quarterly record submission to centralized repository which submits annual reports to the department.

• Prohibits donations to specific patients, resale of donated drugs, and billing third-party payors for donated drugs, though repositories may charge a handling fee; permits Governor to waive patient eligibility requirements during declared state of emergency.

• Provides immunity from civil, criminal, and professional liability for donors and program participants exercising reasonable care; establishes recall protocols and requires destruction of recalled or unsuitable drugs.
