CS/CS/HB 329 Summary

• Creates Section 627.747 allowing private passenger motor vehicle policies to exclude named individuals from personal injury protection, property damage liability, bodily injury liability, and uninsured motorist coverage when the individual is specifically named on the declarations page and the policyholder consents in writing.

• Prohibits named driver exclusions when the excluded individual is injured while not operating a motor vehicle, when the exclusion is unfairly discriminatory under the Florida Insurance Code, or when the exclusion is inconsistent with the insurer's filed underwriting rules.

• Amends Section 324.151 to clarify that owner's liability insurance policies must insure any operator using the vehicle with permission, except for individuals named driver excluded under the new law.

• Amends Section 627.736 to add language that personal injury protection coverage applies to relatives residing in the same household "unless excluded under s. 627.747."

• Amends Section 627.7407 to update insurer notice requirements to inform policyholders that personal injury protection coverage applies to household members "unless excluded under s. 627.747."

• Effective date: July 1, 2018.
