HB 767 - Pay-For-Success Contracts

• Creates section 287.05715, F.S. to authorize state agencies to enter pay-for-success contracts with private, not-for-profit organizations (501(c)(3) entities) that provide upfront capital to fund qualifying services or programs based on achieving specified performance targets and outcome measures.

• Requires contracts to include independent third-party evaluator reports at mid-term and end of contract term, with success payments to the private entity contingent on meeting performance targets and paid within 60 days of evaluation receipt.

• Allows agencies to carry forward unobligated pay-for-success contract appropriations from the General Revenue Fund for up to 3 years if committed for expenditure by June 30 of the fiscal year appropriated.

• Limits eligible services to early childhood education, education and workforce programs, public safety programs, health and human services, and long-term and community-based care services.

• Prohibits private entities from accessing confidential personal client information and requires agencies to submit annual reports by April 1 to legislative appropriations committee chairs; Department of Management Services must prescribe implementation procedures by December 1, 2018.
