HB 835 Summary

• Creates section 430.075, Florida Statutes to authorize counties, municipalities, special districts, and political subdivisions to establish voluntary home caregiver registration programs for in-home care providers serving vulnerable adults.

• Establishes minimum registration requirements including applicant age of at least 18 years and provision of services for more than 3 calendar days per month or 24 days per year (totaling more than 10 hours per month) to unrelated adults.

• Prohibits registration for applicants convicted within the past 15 years of specified offenses including homicide, assault, battery, sexual battery, kidnapping, theft, robbery, abuse of elderly persons or children, and drug-related felonies.

• Requires local ordinances to include application fees (limited to processing costs), public verification processes, identification badges with photographs, appeal procedures, registration terms not exceeding 5 years, and public awareness campaigns at least 6 months before implementation.

• Exempts licensed healthcare professionals, family relatives, charitable and faith-based organizations, and persons providing nonrecurring care (not exceeding 3 days per month or 24 days per year) from registration requirements; effective July 1, 2018.
