HB 1291 Summary

• Allows parents of student qualified patients to request that medical marijuana be administered during the school day by submitting written authorization to the school principal with student ID card, physician certification, and statement of necessity.

• Permits qualified patients to designate multiple caregivers when a parent requests county-designated caregiver assistance during school hours, and allows county-designated caregivers to serve multiple student patients under this provision.

• Requires Department of Health to designate no more than two county health department employees per county as county-designated caregivers, who must obtain caregiver registration and follow department rules.

• Prohibits storage of marijuana on school grounds; requires school principals to designate an isolated area for administration only and prohibits schools from obstructing qualified students from accessing marijuana during the school day.

• Provides funding through the Grants and Donations Trust Fund from departmental fees and requires the department to adopt implementing rules; effective July 1, 2018.
