HB 1333 Summary: Florida Trust Act

• Creates Chapter 908, Florida Statutes ("Florida Trust Act") to prohibit state and local law enforcement agencies, school law enforcement officers, and security agencies from using resources to investigate, arrest, or detain individuals for federal immigration enforcement purposes.

• Prohibits law enforcement agencies from responding to immigration detainer requests, making arrests based on civil immigration warrants, or performing immigration officer functions under federal law; prohibits sharing agency databases for immigration enforcement purposes.

• Restricts state and local law enforcement agencies and health care providers from inquiring about or recording immigration status information, except in limited circumstances when directly relevant to eligibility for services, ongoing investigations, or required by law.

• Requires the Attorney General to develop model policies for K-12 schools, postsecondary institutions, hospitals, and courthouses to limit immigration enforcement assistance; requires these entities to develop and publicize such policies.

• Establishes entitlement to representation for persons unable to afford legal counsel in removal proceedings who were present in Florida when questioned or taken into custody; effective July 1, 2018.
