• Authorizes the Agency for Health Care Administration to revoke or deny license renewal/change of ownership for nursing homes that fail to pay judgments or settlement agreements within 60 days (or up to 6 months with written agreement)

• Requires nursing homes to maintain professional liability insurance of at least $2 million per claim and $4 million annual aggregate, excluding policies that deduct litigation costs from coverage limits

• Changes punitive damages distribution for long-term care negligence cases from 50-50 split to 90 percent to claimant and 10 percent to Quality of Long-Term Care Facility Improvement Trust Fund

• Requires nursing homes and assisted living facilities to report professional liability claims and actions to the Office of Insurance Regulation within 30 days of judgment, settlement, or final disposition

• Effective date: July 1, 2018
