Repeals Florida Statute 766.118, which previously established determination methods and limits on noneconomic damages in wrongful death cases.

Amends section 766.209 to remove the reference to noneconomic damages limitations when a defendant refuses a claimant's offer of voluntary binding arbitration.

Claimants who prove medical negligence after trial (when defendant refuses arbitration) remain entitled to recover prejudgment interest and reasonable attorney's fees up to 25 percent of the award reduced to present value.

Takes effect July 1, 2018.
