• Removes state preemption that prevented local governments from regulating auxiliary containers, wrappings, and disposable plastic bags used by retail establishments.

• Requires the Department of Environmental Protection to analyze the need for new or different regulation of these materials, including input from state and local government agencies, stakeholders, private businesses, and citizens.

• Directs the department to submit conclusions and recommendations to the Legislature no later than February 1, 2010.

• Maintains a prohibition on local government regulation of these materials until the Legislature adopts the department's recommendations.

• Takes effect July 1, 2018.
