City of Tampa authorized and directed to appropriate $5 million to fund a settlement preservation trust for Ramiro Companioni, Jr., as compensation for injuries sustained in a November 22, 1996 motorcycle collision with a City of Tampa Water Department truck.

Final judgment of $17,928,800 was entered in 2004 based on a $19,932,000 jury verdict; parties agreed to compromise settlement of $5 million after appeals and legal remedies were exhausted.

Payment caps established: attorney fees not to exceed $850,000, lobbying fees not to exceed $400,000, and costs and similar expenses not to exceed $7,204.25.

Settlement amount and payment under Florida Statutes § 768.28 constitute sole compensation for all present and future claims arising from the incident.

Lien interests relating to treatment and care of Ramiro Companioni, Jr., are waived or extinguished, excluding federal portions of Medicaid or other liens that the claimant must pay.
