Sexual harassment complaints and related information held by agencies are confidential and exempt from public records requirements under Florida Statutes s. 119.07(1) and Florida Constitution Art. I, s. 24(a)

Exemption terminates when probable cause is determined to exist for the allegation

Personal identifying information of witnesses and alleged victims remains confidential and exempt even after probable cause determination, as provided in s. 119.071(2)(n)

Confidential information may be released upon request to governmental entities performing lawful duties and to the alleged victim and accused individual (or their attorneys) after probable cause is found

Exemption sunsets on October 2, 2023, unless the Legislature reviews and reenacts it before that date
