City of Tampa authorized to appropriate $5 million from unencumbered funds and draw a warrant to establish a special needs trust for Ramiro Companioni, Jr. as compensation for injuries from a 1996 motorcycle collision with a City Water Department truck.

Settlement amount of $5 million represents a compromise from the final 2004 judgment of $17,928,800 that followed a jury verdict of $19,932,000.

$5 million payment and any amounts previously paid under Florida Statutes section 768.28 constitute sole compensation for all present and future claims arising from the 1996 incident.

Attorney fees relating to this claim capped at 25 percent of the $5 million award.

Medicaid and other federal liens relating to Companioni's treatment and care are waived or extinguished, except for federal portions that the claimant must pay.
