SB 530: Risk Protection Order Act

• Creates a civil court procedure allowing family, household members, and law enforcement to obtain temporary orders restricting firearm access for individuals posing significant danger to themselves or others.

• Permits ex parte emergency orders issued same-day or next business day, followed by a full hearing within 14 days; final orders last up to 12 months and may be renewed.

• Requires respondents to surrender all firearms and concealed carry licenses to law enforcement within 48 hours; law enforcement must develop storage and return policies by June 1, 2019.

• Establishes criminal penalties including first-degree misdemeanor charges for filing false petitions or violating orders, with escalation to third-degree felony for repeat violations.

• Mandates firearm return only after background check confirmation of eligibility and requires orders to be entered into state and federal systems including the National Instant Criminal Background Check System.
