Adds legislative findings to Florida Statutes sections 921.141 and 921.142 expressing intent that the Hurst v. State decision (October 14, 2016) apply retroactively to death penalty cases where sentences became final before June 24, 2002.

Legislature finds that the Florida Supreme Court's decision in Asay v. State (December 22, 2016) limiting Hurst to post-June 24, 2002 cases would result in a miscarriage of justice for inmates sentenced before that date.

Applies retroactive Hurst protections to both capital felony cases under section 921.141 and capital drug trafficking cases involving cocaine or opiates under section 921.142.

Effective date: July 1, 2018.
