Repeals section 766.118, Florida Statutes, which previously limited noneconomic damages in wrongful death suits.

Removes the cap on noneconomic damages that claimants can recover when a defendant refuses voluntary binding arbitration.

Allows claimants who prove medical negligence to recover damages without the limitations previously imposed by section 766.118.

Permits recovery of prejudgment interest and reasonable attorney fees up to 25 percent of the award reduced to present value.

Takes effect July 1, 2018.
