CS for SB 1214 - Child Exploitation

• Repeals former s. 827.071 (sexual performance by a child) and creates new s. 847.003 with identical prohibitions, relocating the offense to chapter 847 (obscenity and child exploitation)

• Creates new s. 847.10 establishing investigative subpoena procedures for crimes involving child sexual exploitation and abuse, including nondisclosure requirements with judicial review and enforcement provisions

• Comprehensively revises s. 847.0137 to define child pornography, establish separate possession and transmission offenses with specific penalties, and include detailed definitions of visual depictions and identifiable minors

• Updates numerous Florida statutes to reference the relocated child exploitation offenses (ss. 847.003 and 847.0137) in contexts including sentencing guidelines, sex offender registration, probation conditions, and disqualification standards

• Renames chapter 847 as "Obscenity; Child Exploitation" and directs the Division of Law Revision to capitalize "Child Protection Team" throughout the statutes; effective October 1, 2018
