Creates the "Free Enterprise Protection Act" establishing section 760.65 of Florida Statutes to prohibit government discrimination against business entities.

Defines "discriminatory action" to include altering tax treatment, denying tax exemptions or benefits, withholding government contracts/licenses/grants, or denying access to property, facilities, forums, or fundraising campaigns.

Prohibits governmental entities from taking discriminatory actions against businesses based on the business's internal policies (including personnel and employee benefit policies compliant with state law) or the business's exercise of constitutional rights including freedom of expression and free exercise of religion.

Applies to all branches, departments, agencies, and instrumentalities of state government, political subdivisions, and persons acting under color of state law.

Effective date: July 1, 2018.
