Requires licensed nursing homes to maintain general and professional liability insurance coverage of at least $1 million per claim at all times.

Prohibits insurance policies from deducting litigation costs or attorney fees from the liability limits or reducing coverage available for settlements or judgments based on defense costs.

Repeals section 400.0238, Florida Statutes, which previously addressed punitive damages and limitations on awards for nursing home liability.

Updates the Quality of Long-Term Care Facility Improvement Trust Fund to be funded solely through proceeds from section 429.298, removing the previous reference to section 400.0238.

Takes effect July 1, 2018.
