SB 1640 - Vacation Rentals

• Requires persons engaged in transient public lodging establishments to display valid certificate of registration numbers in rental listings and advertisements, with civil penalties of $50-$100 per day for non-compliance.

• Creates new "commercial vacation rental" classification for vacation rentals managed by a licensed agent for five or more units or part of five or more units under common ownership, control, or management.

• Establishes registration requirement for "hosting platforms" that advertise transient public lodging establishments, with annual fees not to exceed $1,000 based on number of properties served; hosting platforms prohibited from listing unlicensed properties.

• Grants local governments authority to regulate vacation rental activities that apply uniformly to all residential properties and activities in owner-occupied single-family residences, while preempting local duration and frequency regulations.

• Provides amnesty program through October 1, 2018, for unpaid vacation rental taxes, penalties, and interest for persons who register and apply by the deadline, excluding previously finalized assessments.
