SB 1696 Summary

• Creates Florida Statute 794.10 to prohibit early release or sentence suspension for sexual offense convictions when the victim was incapacitated by intoxication, anesthetic substances, controlled substances, unconsciousness, or sleep.

• Applies to felony violations of Chapter 794 (sexual offenses) and section 800.04, excluding section 794.011(10).

• Bars probation, community control, parole, conditional release, control release, and all other forms of early release for offenders who knew or reasonably should have known of the victim's incapacitated state at the time of the offense.

• Effective for offenses committed on or after October 1, 2018.
