Counties, municipalities, and other political subdivisions are prohibited from regulating vegetable gardens on residential properties, and any existing local ordinances on this matter are void and unenforceable.

Local governments may still adopt general regulations that do not specifically target vegetable gardens, such as water use restrictions during droughts, fertilizer use rules, and invasive species controls.

"Vegetable garden" is defined as a plot of ground where herbs, fruits, flowers, or vegetables are cultivated for human ingestion.

The Legislature declares that encouraging sustainable cultivation of vegetables and fruits at all production levels, including personal consumption, is an important state interest.

Effective date: July 1, 2019.
