Local governments must add a property rights element to their comprehensive plans by the earlier of their next plan amendment or July 1, 2022

Property rights to be considered in local decisions include: physical possession and control of property, quiet enjoyment, use and development, privacy and exclusion of others, and disposal through sale or gift

Local governments may create their own property rights element or adopt the statutory statement of rights, but custom elements cannot conflict with the statutory version

Comprehensive plans adopted after January 1, 2019 must incorporate existing development orders and cannot impair completion of developments or modify previously approved density and intensity

Effective date: July 1, 2019
