Local governments may not carry forward unexpended building code enforcement fee revenue exceeding the average of their operating budgets for the previous 4 fiscal years, excluding reserve amounts.

Local governments that established a Building Inspections Fund Advisory Board with 5 construction stakeholder members as of January 1, 2019 may continue carrying forward excess funds upon the board's recommendation.

Excess funds that cannot be carried forward must be used to rebate and reduce fees or, upon industry recommendation, fund nonprofit organizations under section 501(c)(3) of the Internal Revenue Code to expand construction industry training.

Local enforcement agencies may not charge additional fees for proof of licensure, license recording or filing, or workers' compensation insurance documentation during permit applications.

The act takes effect July 1, 2019.
