Licensed facilities must immediately notify patients when placed on observation status rather than inpatient status using forms adopted under 42 C.F.R. s. 489.20 for Medicare patients or forms adopted by agency rule for non-Medicare patients

Notification of observation services must be documented in the patient's medical records and discharge papers

Patients, survivors, or legal guardians must be notified of observation services through discharge papers, which may include brochures, signage, or other forms of communication

Effective date is July 1, 2019
