CS/HB 831 - Electronic Prescribing Summary

• Requires certain health care practitioners with electronic health records systems to electronically transmit prescriptions for medicinal drugs upon license renewal or by July 1, 2021, whichever is earlier.

• Establishes exceptions to the electronic prescribing requirement for situations including when practitioner and dispenser are the same entity, prescriptions cannot be transmitted under current standards, practitioners have approved waivers, or patients need to compare pharmacy prices.

• Prohibits electronic prescribing software from using economic incentives or other means to influence prescribing decisions at the point of care through advertising, messaging, or pop-up ads.

• Allows electronic prescribing software to display payor formulary information only if it does not preclude or make more difficult patient selection of pharmacies or practitioner selection of medications.

• Takes effect January 1, 2020.
