CS/HB 845 Summary

• Amends Florida Statutes section 119.0714 to create a public records exemption for identifying information about petitioners and respondents in protective injunction petitions for domestic violence, repeat violence, dating violence, sexual violence, stalking, or cyberstalking.

• Exempts identifying information, affidavits, notices of hearing, and temporary injunctions from public disclosure until the respondent has been personally served with the petition and related documents.

• Maintains existing exemptions for dismissed petitions filed on or after July 1, 2017, and requires signed written requests for dismissed petitions filed before July 1, 2017, with no fees charged for such requests.

• Establishes a public necessity statement finding that premature release of identifying information could threaten the physical safety and security of petitioners, their families, and law enforcement serving the petition.

• Takes effect July 1, 2019.
