CS/CS/CS/HB 933 - Office Surgery

• Requires offices where physicians perform liposuction procedures removing more than 1,000 cubic centimeters of fat, Level II office surgeries, or Level III office surgeries to register with the Department of Health unless licensed as a facility under chapter 395.

• Mandates each registered office designate a physician responsible for compliance with office safety requirements, who must have an active license and practice at that office, with 10-day notification requirement for physician changes.

• Authorizes the department to suspend or revoke office registration for noncompliance and to deny registration to persons associated with revoked offices for 5 years; allows the department to impose penalties against the designated physician for office failures.

• Imposes a $5,000 per day fine on physicians who perform covered procedures or surgeries in unregistered offices and makes such conduct grounds for license denial or disciplinary action.

• Requires the Board of Medicine and Board of Osteopathic Medicine to adopt rules governing standards of practice for office surgeries and to administer registration, inspection, and safety of office surgery facilities; effective July 1, 2019.
