CS/HB 1035 - Patient Access to Records

• Requires service providers, health care practitioners, and facilities to furnish patient records within 14 working days of request (10 working days for in-person access to examine original records).

• Mandates that providers offering electronic health record systems must furnish requested records in the format chosen by the requester, including electronic format, web-based patient portal access, or electronic personal health record submission.

• Removes the requirement that licensed facilities furnish patient records only after discharge, allowing access during patient stay.

• Creates section 408.833 establishing definitions and procedures for client access to medical records at health care facilities, with providers authorized to impose reasonable terms to preserve records.

• Effective date: July 1, 2019.
