Broward County became a charter county in 1975 and transferred functions of ex officio clerk of the board of county commissioners, county recorder, auditor, and custodian of county funds to the County Administrator.

Amendment 10, approved by Florida voters on November 6, 2018, eliminates county charter authority to transfer these functions, requiring them to return to the clerk of the circuit court effective January 7, 2025, unless otherwise provided by special law.

The bill authorizes transfer of clerk of the circuit court functions relating to ex officio clerk, auditor, recorder, and custodian of county funds back to the County Administrator of Broward County, subject to voter approval via referendum.

The Board of County Commissioners must submit the referendum question to Broward County voters on the same date as the November 2020 general election, with subsequent referendum elections permitted if the measure fails.

The bill takes effect July 1, 2019, except that Section 2 becomes effective January 7, 2025, only if a majority of county voters approve the referendum.
