Creates section 390.305, F.S. to exempt physician abortion reports filed with the Department of Health from public records disclosure requirements under Florida Statutes and the State Constitution.

Prohibits the Department of Health from making such reports available for public inspection and requires the department to maintain their confidentiality.

Allows reports to be disclosed only to the Attorney General or state attorney in criminal investigations related to s. 390.301(4)(d) or (6), or pursuant to a court order in actions brought under s. 390.301(7).

Applies retroactively to reports filed before, on, or after January 1, 2020.

Sunsets on October 2, 2024, unless reviewed and reenacted by the Legislature under the Open Government Sunset Review Act.

Takes effect contingent on HB 1345 or similar legislation being adopted in the same legislative session and becoming law.
