HB 5301 - Information Technology Reorganization

• Transfers all powers, duties, functions, personnel, records, and assets of the Agency for State Technology to the Department of Management Services via type two transfer effective July 1, 2019, establishing the Division of State Technology within DMS.

• Creates the position of state chief information officer (requiring 10+ years executive-level IT experience) and state chief information security officer to lead the reorganized division.

• Establishes a "cloud-first" policy requiring state agencies to adopt formal procedures for evaluating cloud-computing solutions and submit annual strategic plans for their application migrations to the Governor and Legislature.

• Removes the Agency for State Technology and transfers its data center operations to DMS while requiring agencies to consolidate computing facilities into the state data center unless exempt by law.

• Creates the Florida Cybersecurity Task Force (adjunct to DMS) with members from law enforcement, emergency management, and private sector to assess state cybersecurity infrastructure and recommend improvements, with final report due November 1, 2020.
