CS/HB 7109 - Criminal Justice Data Transparency

• Requires local and state criminal justice agencies (courts, prosecutors, public defenders, jails, DOC) to collect and report uniform criminal justice data to the Department of Law Enforcement on a monthly basis starting in 2019

• Mandates the Department of Law Enforcement publish all received data in machine-readable format on its website, searchable by county, circuit, data elements, and unique identifier, with all data published by January 1, 2020

• Establishes penalties for noncompliance, making agencies ineligible to receive state funding for 5 years if they fail to comply with data reporting requirements

• Requires development of uniform arrest affidavit specifications and criminal charge/disposition statute crosswalk tables by October 1, 2019, with mandatory adoption by all law enforcement agencies and courts by July 1, 2020

• Protects confidentiality of information that is exempt under state law when collected by agencies, maintaining the same confidential status when reported to the state
