HB 7119 Summary

• Raises the minimum age for purchasing tobacco products, nicotine products, and nicotine dispensing devices from 18 to 21 years old across all Florida statutes.

• Preempts local governments from establishing their own minimum age requirements for tobacco and nicotine products, while preserving local authority to require retail licensing.

• Prohibits physicians from issuing medical marijuana certifications for smoking to patients under 21 years of age except in cases of terminal illness with documented pediatric specialist concurrence.

• Makes it unlawful for persons under 21 to possess tobacco or nicotine products, punishable by noncriminal violation with community service, fines up to $25, and mandatory anti-tobacco/nicotine programs.

• Takes effect October 1, 2019.
